Peru: Indecopi published the annual auditing plan for 2025

In brief

On 27 December 2024, the National Institute for the Defense of Free Competition and the Protection of Intellectual Property (Indecopi) published its annual auditing plan (PAF) for 2025 through Resolution No. 00193-2024-GEG/INDECOPI.

The PAF outlines the planning of the supervisory activities that Indecopi will prioritize throughout the year to ensure compliance with regulations under its jurisdiction at a national level. These activities include areas such as consumer protection, combating unfair competition, defending free competition and eliminating bureaucratic barriers, among others.


Contents

The following is a list of the main sectors considered by Indecopi in its PAF at both the Lima and Callao as well as macro-regional levels:

  3. International passenger air transportation
  4. Cab service applications
  5. Food intended exclusively for babies

Macro-regional level

  1. Ground, interprovincial, urban and interurban transportation services
  2. Primary and/or secondary schools, universities and institutes
  3. Restaurants and similar establishments
  4. Nationwide passenger air transportation
  5. Food and beverages
Repression of unfair competition

Lima and Callao

  1. Sale of chewing gum, candies, among others
  2. Cab service applications
  3. Nonuniversity higher education (institutes)
  4. Beers and alcoholic beverages of all kinds
  5. Fruit and vegetable juices and nectars
  6. Television sets

Macro-regional level

  1. Hotel accommodation
  2. Interprovincial land transportation services
  3. Primary and/or secondary schools, universities and institutes
  4. Restaurants and similar establishments
  5. Sale of land
  6. Clothing
Defense of free competition

The prioritized sectors are not expressly specified due to the confidentiality of the research.

However, priority will be given to the following markets: a) those related to basic shopping basket goods; b) concentrated markets with entry barriers; and c) markets where there are indications of anticompetitive behavior based on the monitoring of public sources and/or informative reports.

Additionally, the PAF specifies that priority will be given to cases involving conduct subject to absolute prohibition (cartels).

 

The PAF specifies that, notwithstanding the aforementioned sectors, Indecopi may carry out additional unplanned auditing actions in response to evidence of possible noncompliance with auditable obligations that pose a risk equivalent to that of the prioritized sectors.

In this scenario, the timely implementation of compliance programs by companies in the sectors identified by Indecopi is particularly relevant to successfully face the authority's enforcement actions.
