The ecosystem of trade through electronic systems, or what is generally referred to as e-commerce, is currently growing rapidly in Indonesia. To create a fair and healthy trade ecosystem for the empowerment of Micro, Small and Medium Enterprises (MSMEs) and trade business actors through e-commerce, in September 2023, the government issued Minister of Trade Regulation No. 31 of 2023 on Business Licensing, Advertising, Development and Supervision of Business Players in Electronic Commerce ("MOT Regulation 31"). One of the provisions in MOT Regulation 31 is a minimum price requirement for goods originating from offshore that can be traded through an e-commerce platform.
On 19 December 2023, the MOT issued Decree No. 1998 of 2023 on the Stipulation of Finished Goods of Foreign Origin With Prices Below the Minimum Price of Goods Allowed to Enter Directly Through Electronic Commerce Operators Conducting Cross-Border Electronic Commerce Activities ("MOT Decree 1998") that provides list of goods that are exempted from the minimum price requirement under MOT Regulation 31.
