By means of Resolution No. 58/2025 ("Resolution"), the Secretariat of Innovation, Science and Technology ("Secretariat") approved the General Regulation for Satellite Management and Services ("Regulation"), which repeals the previous regulations (Resolution Nos. 2325/1997 and 3609/1999). The new Regulation aims to optimize and unify administrative procedures related to the provision of satellite facilities and services by both geostationary and non-geostationary satellites.
The Secretariat had created the Registry for the Provision of Satellite Facilities and approved the procedure and the requirements for registration (Resolution No. 12/2024). Additionally, Decree No. 70/2023 had established that the provision of facilities for satellite communication systems is free and requires the holders of such systems to register for their operation, solely to coordinate the use of radio frequencies and avoid interference with other systems according to the regulations to be issued.
The Regulation updates and simplifies the regulatory framework for those interested in providing satellite facilities in Argentina. Among other things, and to coordinate the use of radio frequencies and avoid interference with other systems, applicants must submit specific documentation related to geostationary and/or non-geostationary systems.
Providing any ICT service by satellite is subject to the general regime for the provision of ICT services and requires obtaining a license beforehand, registering the service and securing the corresponding authorizations for spectrum use.
The Regulation contemplates the possibility for the authority to establish a fee for the registration of any satellite system operating in Argentina.
