On 1 May 2025, the State Council of the People's Republic of China released the revised Regulations on the Protection of New Plant Varieties ("Revised Regulations"), which are set to take effect on 1 June 2025.
Although the revisions do not bring about significant changes to the current Seed Law of the People's Republic of China ("PRC Seed Law"), they reflect the legislative bodies' awareness of the practical difficulties faced in the application and enforcement of plant variety rights (PVR). In this article, we will summarize and comment on the main updates, and explore the potential impacts of these changes based on our practical experience in the breeding industry.
