With the main goal of ensuring transparency and protecting consumers from potential deception and unfair practices, the Secretariat has implemented a new regulatory framework aimed at clarifying advertising messages in general and avoiding information overload.
In this regard, the Resolution repeals Resolution No. 12/2024. It requires that details regarding the offer’s validity period and territorial scope, the provider’s name, address, and tax identification number, as well as the conditions of sale and any applicable stock limitations, be made accessible through a website or an alternative communication channel by incorporating specific phrases in the advertisement.
Additionally, the Resolution sets out the manner in which the prices of goods or services offered must be advertised, in accordance with the provisions of Resolution No. 4/2025 issued by the Secretariat.
On the other hand, the advertising and promotion of (i) online gambling and betting and (ii) resales of tickets for shows, sporting events or artistic performances are specifically regulated.
Accordingly, the Resolution provides for the following:
- The obligation to include the mandatory legend “This is a ticket resale site” on unofficial websites through which tickets for shows, sporting events or artistic performances are sold.
- The format and mandatory information to be included in advertisements for online gambling and betting disseminated via the internet, media platforms or social networks, public signs, print and audiovisual media, and any other format, such as the warning “Compulsive gambling is harmful to health” and the legend “18+”.
- The creation of a reporting channel to provide information to the enforcement authority regarding individuals or influencers who, through social networks and any other format, media or platform, promote online gambling and betting sites without including the mandatory legend, or who engage in any other conduct that violates the applicable regulations on fair commercial practices.
Finally, the Resolution will enter into force 30 days after its publication in the Official Gazette.
