Despite the suspension of activities, in order to preserve the exercise of the public service of justice, the Federal Judiciary Council has determined that the jurisdictional bodies will only attend to urgent cases. To determine whether a case is urgent, the following must be considered: i) When human rights may be violated, and the significance of any possible violation; and ii) the possible impacts on access to economic and social rights for people in vulnerable situations.
- Federal Criminal Justice Centers:
- Qualification of detentions.
- Links to the process.
- Implementation and modification of precautionary measures related to preventive detention.
- Extradition determinations.
- Hearings of trials initiated before the suspension.
- Justice Centers and District Courts specialized in execution matters:
- Decisions that involve danger to the life or integrity of people.
- Procedures prior to the imminent serving of the sentence.
- Pre-release benefits pending execution.
- Urgent agreements on internment conditions.
- District Courts:
- Procedures to receive preparatory statements.
- Actions in the pre-instruction period.
- Decisions on the execution of sanctions that involve danger to the life or integrity of people.
- Arrest warrants.
- Acts that endanger the health or integrity of people.
- Matters related to the right to health and migrants.
- Matters that may endanger the supply of basic services.
- National Center for Justice specialized in control of investigation techniques, detention, and communication interception:
- Precautionary measures, precautionary provisions, and investigation techniques.
- Federal Labor Court for collective matters and Federal Labor Courts for individual matters:
- Collegiate Circuit Courts:
- Complaints derived from urgent amparo trials.
- Continuity of decisions and procedures prior to the suspension of activities.
- Collegiate Appeal Courts:
- Complaints and appeals in criminal matters.
- Civil matters:
- Precautionary and protective measures in cases of domestic violence and violence against women.
- Determinations on alimony and amparo affecting minors.
- All matters:
- Resolution of jurisdictional conflicts related to urgent acts.
- General criteria:
- To determine if a matter is urgent, human rights at stake, the significance of their violation, consequences, and possible impacts, especially on health, will be considered.
- Other urgent matters:
- Judges may determine if a matter is urgent.
The Filing Offices and the electronic system will continue to operate only for urgent matters, with minimal essential personnel and through remote work when possible.
Suspension of deadlines. Notice 16/2024 does not expressly establish the suspension of deadlines and procedural terms, nor does it declare work stoppage days as non-working days. Some Courts and Tribunals have issued their own circulars in which they expressly establish the suspension of deadlines and procedural terms, however, a general circular establishing such suspension has not yet been published. For this reason, at the Firm we continue to attend to each of the matters until ensuring that such suspension exists.
