On 10 July 2014, Law No. 30220 ("University Law") entered into force. Article 45.1° establishes that in order to obtain a bachelor's degree, one must not only graduate but also have passed the undergraduate studies, as well as gained approval of research work and the knowledge of a foreign language, preferably English or a native language. In other words, the automatic baccalaureate established by Legislative Decree No. 882 was eliminated.
However, the University Law itself established that these requirements only apply to students who began their studies on or after 10 July 2014.
Subsequently, numerous changes have been presented, which are summarized below.
Law |
To whom would the automatic baccalaureate degree continue to apply? |
To whom would Article 45.1° apply in relation to obtaining the baccalaureate degree? |
Law No. 30220 |
Students who began their studies before 9 July 2014 (one day before the University Law came into force). |
Students who entered university after 10 July 2014. |
Law No. 31183 |
Students who passed their undergraduate studies in 2020 or 2021. |
Students who entered university on or after 10 July 2014 and who completed their undergraduate studies before 1 January 2020. |
Law No. 31359 |
Students who passed their undergraduate studies in 2021, 2022, or 2023, including the 2023-2 cycle. |
Students who entered university on or after 10 July 2014 and completed their undergraduate studies after the end of the 2023-2 university cycle. |
Law No. 31803 |
Students who passed their undergraduate studies before 31 December 2023. |
Students who entered university on or after 10 July 2014 and completed their undergraduate studies after 31 December 2023. |
Law No. 31971 |
Students who passed their undergraduate studies before 31 March 2024. |
Students who entered university on or after 10 July 2014 and completed their undergraduate studies after 31 March 2014. |
This new extension established by Law No. 31971 applies to students who complete their undergraduate studies by 31 March 2024. In other words, if a student completes their undergraduate studies by 31 March 2024, they can apply for the automatic baccalaureate, without being required to comply with the conditions set forth in Article 45.1°1 of the University Law.
The original deadline led to many universities modifying their bylaws and regulations, incorporating the requirements of Article 45.1° of Law No. 30220 into their internal regulations. However, the deadline for these requirements to be applicable has been extended again. In view of this, we suggest that universities –public and private– adapt their internal regulations and bylaws, so that they comply with the new legislation and new deadlines.
