Brazil: Ministry of Labor and Employment steps up enforcement of compliance with equal pay law

The National Coordination for Combating Discrimination, Harassment, and Violence, and Promoting Equality and Opportunities in the Workplace, part of the MTE’s Labor Inspection Secretariat, launched a national operation called “Operativo Nacional CONA IGUALDADE 2025“. This operation aims to monitor compliance with the equal pay law, with a special focus on the publication of the Pay Transparency and Remuneration Criteria Reports.

In recent months, the MTE has adopted a more stringent stance, notifying several companies through their Electronic Labor Domicile (DET) to submit additional documents and/or provide clarifications regarding published Wage Transparency Reports.

To date, approximately 90 companies have been cited for non-compliance with Law No. 14,611/2023, with administrative fines of up to 3% of the employer’s payroll, capped at 100 minimum wages, in addition to sanctions applicable to cases of wage discrimination and compensation criteria.

Recommendation

In the coming months, the MTE is expected to inspect more than 810 companies nationwide. Therefore, it is important that all companies keep their DET registrations up to date and regularly check the system to monitor notifications and fines, thus avoiding missed deadlines.
