Brazil: Updates on electronic systems for administrative and judicial labor proceedings

The Labor Judiciary and the Ministry of Labor and Employment have implemented new electronic systems to communicate with companies about administrative and judicial labor proceedings.

  • Electronic Judicial Domicile (Domicílio Judicial Eletrônico (DJE)): regulated by Resolution 455 of the National Council of Justice. It is a free and digital tool that concentrates all communications about judicial disputes before the Judiciary in a single platform, with staggered compulsory implementation.

The next phase of the project began on 1 March 2024 and will end on 30 May 2024. During this period, medium-sized and large private companies should voluntarily register within the system. After that, registration will be compulsory and based on the data made available to the Brazilian IRS.

  • Labor Electronic Domicile (Domicílio Eletrônico Trabalhista or (DET)): regulated by Decree 11,905/24, this is a Federal Government system managed by the Ministry of Labor and it is already available and accessible to companies.

The main purpose of the new system is to inform companies of administrative assessments, labor inspection actions, formal notifications, and notices in general, as well as to allow companies to file documents, defenses, and appeals in administrative proceedings.

Decree 11,905/24 establishes that the companies must adopt the Inspection Book in electronic format, replacing the printed/hard copy version.

Recommended actions

Considering the implementation of the new electronic systems, it is essential to revisit the internal practices used by companies to monitor judicial and administrative proceedings, especially considering the possibility of triggering administrative fines and impacting the legal deadlines for the companies to act in the administrative and judicial labor proceedings.
