Peru: Complementary provisions for the implementation of the MTPE Electronic Mailbox have been published

In 2024, notification via the electronic mailbox of the Ministry of Labor and Employment Promotion (MTPE) became mandatory for all legal entities and public administration entities. The purpose of this requirement is to improve efficiency and security in the communication of administrative acts, actions and services provided exclusively by the MTPE.

In this context, on 2 January 2025, Ministerial Resolution No. 209-2024-TR came into force. This resolution publishes complementary provisions to regulate the implementation, access, correct operation and maintenance of the MTPE's Electronic Notification System.

1. Obligations

  • Mandatory electronic notification: All legal entities and public administration entities must use the MTPE electronic mailbox to receive administrative notifications.
  • Affiliation to the electronic mailbox: Legal entities must complete an application form and attach the required documentation, including a certificate of power of attorney.
  • Confirmation of receipt: Users must confirm receipt of notifications within five business days.

2. Responsibilities

  • Custody of passwords: Legal entities must safeguard their passwords and prevent misuse by third parties.
  • Updating data: Users must keep their electronic mailbox data updated and change their passwords periodically.
  • Attention to alerts: Users must pay attention to notification alerts sent to their registered email and cell phone number.

3. Relevant information

  • Accessibility and confidentiality: Access to the electronic mailbox is available 24 hours a day, 365 days a year, and the information contained therein is exclusively accessible to the user.
  • Free of charge mailbox: The use of the electronic mailbox is free of charge for all legal entities and public administration entities.

4. Minimum information required to register

  • Personal data: Taxpayer Registration Number (RUC), company name, address, type and number of identity document, first and last names, email and cell phone number.
  • Additional documentation: Certificate of validity of power of attorney for legal entities and resolution of designation for public administration entities.

5. Deadlines and validity of notifications

  • Notification deadlines: Notifications are made from Monday to Friday during the MTPE's business hours (8 am to 4:30 pm). If the notification is made outside these days and hours, it is considered to be notified on the following working day.
  • Confirmation of notification: The user must confirm receipt within five working days. If they fail to do so, the notification will be considered valid as of the business day following the expiration of this term.

6. Cancellation of the registration

  • Cancellation assumptions: The electronic box may be cancelled in the event of the individual's death or the extinction of the legal entity.

According to Supreme Decree No. 004-2024-TR, the adaptation period is 45 calendar days from the publication of the complementary provisions on 29 December 2024. Therefore, starting from 12 February 2025, registration on the platform will be mandatory to access the electronic mailbox.
