Peru: COVID-19 - state of national emergency repealed

By means of Supreme Decree No. 030-2022-PCM, the government has repealed Supreme Decree No. 016-2022-PCM, Supreme Decree declaring a State of National Emergency, as well as the decrees that provide for their extensions and modifications.


Contents

The repeal of the State of National Emergency generates the following consequences:

  • The mandatory use of a mask in health establishments, vehicles for the transport of people, and closed spaces without ventilation is no longer required.
  • The mandatory use of a mask for people with respiratory symptoms, both in open and closed spaces, is no longer required.
  • The accreditation of the COVID-19 vaccination dose in Peru for Peruvians, resident foreigners and nonresident foreigners is no longer effective.
  • The constitutional freedoms and rights relating to personal liberty and security, the inviolability of the domicile, and freedom of assembly and transit in the territory are restored.

It is also provided that the national government, regional governments and local governments, within the scope of their competencies, should promote the optional use of masks, vaccination against COVID-19 and other measures to promote and monitor healthy practices and activities, in relation to the Health Emergency for which the Ministry of Health, by Ministerial Resolution, will dictate the necessary provisions.

It should be noted that the State of Health Emergency, which was extended until 25 February 2023 by Supreme Decree No. 015-2022-SA, is still in effect. This implies that the obligations that are subject to the validity of the Health Emergency are still in force: prevention plan, surveillance and control of COVID-19 for the workplace, mandatory remote work for pregnant workers, among others.
