In brief
In a recent event held on the occasion of the World Day for Safety and Health at Work, the Labor Authority (SUNAFIL) reported on the actions it has been developing to verify compliance with the law regarding the formation of the Occupational Health and Safety Committee (OHSC). It also called on all companies not only to form the OHSC correctly but also to provide it with the necessary tools to identify and manage occupational risks.
The information provided by SUNAFIL is in line with the inspection campaigns that we have seen an increase during the last few months. The purpose of these campaigns has been (i) to verify that every company with 20 or more workers has an OHSC and (ii) that the OHSC has been chosen in compliance with the requirements and formalities of the law.
Failure to comply with these provisions could result in fines related not only to the obligation to have an OHSC but also to other obligations, such as adequate training for the members of the OHSC and approval of the management instruments under its responsibility (Internal Health and Safety Regulations, Annual Plan, Annual Training Program, etc.).
To avoid penalties related to this matter, we offer the following services:
1. Evaluation of the election and set up of the OHSC
We will review the election process from the beginning: subjects obliged to participate, union participation (if applicable), calls, deadlines, etc. After this review and analysis, we will issue an assessment of compliance with the law, including recommendations and proposals for improvement.
2. Specialized training for OHSCT members
Occupational Health and Safety regulations require that OHSC members receive training to properly perform their duties. We have designed specialized training that provides tools for OHSC members to understand their responsibilities and actively contribute to the company's safety and health management system.
