Peru: New electronic mailbox for MTPE administrative procedures will be mandatory

On 30 August 2024, Supreme Decree No. 004-2024-TR was issued, making it mandatory for the Ministry of Labor and Employment Promotion (MTPE, for its abbreviation in Spanish) to notify administrative actions via electronic mailbox, to optimize the efficiency and speed of administrative procedures.

The following are the most relevant points regarding this new provision:

What is the MTPE electronic mailbox? It is an electronic mailbox created in the Electronic Notification System of the MTPE and assigned to the user. Its purpose is to ensure a secure and reliable processing of notifications within the framework of administrative procedures and actions of the MTPE.
How do I get my electronic mailbox?

The MTPE assigns users an electronic mailbox in the Electronic Notification System free of charge. It will be a mandatory digital address, through which the respective notifications will be made.

The MTPE will publish a ministerial resolution to approve the necessary complementary provisions to obtain the electronic mailbox.

What is reported? All documents issued within an administrative procedure, those that should be notified to users (economic rulings, decrees, conciliations and coercive collection letters, among others), as well as documents that refer to actions on services provided exclusively by the MTPE.
How is notification via electronic mailbox carried out?

Notification of all administrative actions of the MTPE via electronic mailbox will be mandatory. It will have the same validity as notifications made physically.

The notification process via the MTPE electronic mailbox will be carried out as follows:

  • The administrative action is deposited in the user's electronic mailbox and must contain:
    • The full text of the administrative action and annexes.
    • The identification of the procedure where it was issued.
    • The units of the MTPE from which it originates.
    • The effective date and a statement as to whether the administrative procedure has been implemented.
    • The details of the appeals that may be filed, the body before which they must be filed and the respective deadline.

After that, the electronic notification and acknowledgment receipt are generated. Likewise, a notification is sent to the user's registered email address and cell phone number.
The proof of notification via electronic mailbox and the acknowledgment receipt are included in the administrative file.

Obligations of users
  • Periodically check your assigned electronic mailbox to stay on top of the documents that are notified to you.
  • Keep your registered email and cell phone number up to date to receive alerts from the MTPE's Electronic Notification System.
  • Maintain confidentiality and adopt security measures in the use of the username and password assigned to the electronic mailbox.
When is the notification considered to have been made? The notification becomes effective on the day it is recorded as received in the electronic mailbox or, if falling on a nonbusiness day, as of the first following business day.
The computation of time expressed in days begins on the next business day after they become effective, unless a different date is indicated in the administrative action.
When can the MTPE electronic mailbox begin to be used? Within a term not exceeding 90 working days, that is, no later than 17 January 2025, the MTPE must publish a schedule for the phased implementation of this electronic mailbox nationwide.
