Peru: Possible restrictions on the entry of foreigners to Peru and new obligations for lessors of real estate to foreigners are established

Possible restrictions on entry to Peru: Immigration could limit the entry and transit of foreign citizens for reasons of national security, public health, internal order, public order and citizen security, in accordance with the principle of proportionality and sovereignty.

Obligations for lessors of real estate to foreign citizens: Lessors of real estate have the following obligations:

  • Require the presentation of a document evidencing the regular immigration status of the foreigner with whom the lease contract is signed and of other foreigners who inhabit and are part of the lessor group in the same property.
  • It is suggested to request one of the following documents from foreign citizens:
    • Passport and/or identity card and copy of the Andean Migration Card (TAM) to verify if the foreigner has legal permanence in force
    • Document issued by migrations or foreign affairs with the corresponding visa, foreigner's card, temporary residence permit card (CPP), among other things
  • Inform migrations through the "Virtual Migration Agency" about the lease to foreigners.

The regulations will provide more details on these obligations.

During a state of emergency, the constitution is not annulled. It is an exceptional measure that allows the restriction of four rights, to face and overcome the serious circumstances that affect the country.
