Peru: Pregnant workers will be entitled to social security coverage from the first day of enrollment

In brief

On 14 January 2025, Supreme Decree No. 001-2025-TR was published, amending Article 35 of the Regulations of the Law for the Modernization of Social Security in Health, and stipulating that social security coverage for pregnant women will be granted immediately.

The following are the most important aspects to be considered:

  • Until 2022, pregnant women were required to have three months of consecutive or nonconsecutive contributions to EsSalud at the time of conception to obtain the right to coverage, as well as the right to maternity and breastfeeding subsidies.
  • On 10 May 2022, Law No. 31469 was published, establishing that pregnant women would immediately obtain the right to coverage upon enrollment, regardless of their situation at the time of conception. However, this rule had not been applied due to lack of regulation.
  • The regulations governing the recognition and payment of economic benefits in favor of mothers are still pending revision, for which a period of 90 calendar days has been granted.
