Peru: SUNAFIL starts OSH control campaign - Internal Regulations on Occupational Safety and Health

The Superintendence of Labor Inspection (SUNAFIL) has started a campaign to verify compliance with the obligations set out in the Internal Regulations on Occupational Safety and Health (RISST). This involves the delivery of letters through which SUNAFIL requests that companies demonstrate compliance with their obligations related to this management instrument.

In this regard, we recommend that you consider the following:

  • All companies (regardless of their economic activity) with 20 or more employees must have RISST. Naturally, companies with less than 20 employees can also prepare this document, although they are not obliged to do so.
  • The RISST will only be valid if they have been approved by the OSH Committee. It is important to have the minutes of the corresponding meeting, where there is a record of the approval.
  • In addition, the RISST must be delivered to each employee, who will then sign an acknowledgement of receipt for the company. The parent or user companies are obliged to deliver a copy of their RISST to the personnel brought to their facilities by third parties.
  • The minimum content that the RISST should include has been approved by the Ministry of Labor through Ministerial Resolution 050-2013-TR. This resolution approves only a minimum content outline. It is essential that the RISST incorporate all the safety standards for the activities performed by each company in detail.

Not having RISST constitutes a very serious OSH violation, which may be punished with fines ranging from PEN 13,544.50 to PEN 270,529.50, depending on the number of employees the employer has.
