Peru: Charges for water use and discharge of treated wastewater for 2025

In brief

On 14 December 2024, Supreme Decree No. 015-2024-MIDAGRI ("Supreme Decree") was published, establishing the value of the charges for the use of water and the discharge of treated wastewater to be applied in 2025. The Supreme Decree becomes effective on 1 January 2025.

The value of the charges for water use and the discharge of treated wastewater is determined according to the type of water use and the type of wastewater and generating source, considering social, economic and environmental criteria.

The main provisions of the Supreme Decree are as follows:

  1. The value of the charges for the use of surface and subsurface water considers the following criteria:
    1. The annual volume of water used in cubic meters.
    2. A specific differentiated value for the main uses in soles per cubic meter, considering economic criteria for the productive sectors and social criteria for the population and agricultural sectors.
    3. Environmental criteria, which include water availability for water use (high, medium and low), and for groundwater use, it is classified into under-exploited, balanced and over-exploited aquifers.
  2. To determine the value of the charges for the discharge of treated wastewater, the following will be considered:
    1. The annual volume discharged in cubic meters, according to the corresponding authorization.
    2. A specific value for the discharge of treated wastewater in soles per cubic meter, according to the hazardous nature of the substances contained in the effluent.
    3. Environmental criteria, based on the sensitivity of the receiving body according to the categories of the Environmental Quality Standards (Supreme Decree No. 002-2008-MINAM).
  3. The value of the charges for the use of seawater in productive activities for 2025 is PEN 0.0024 per cubic meter.

Failure to pay two consecutive installments of the charges would be a cause for the revocation of the right to use water and discharge treated wastewater.
