Brochure related to the Clarified Act issued by the Andean Court

The Andean Court of Justice issued a "Brochure related to the Clarified Act" which includes rulings of prejudicial interpretations in which one or several Andean statutes are recognized as clarified, which, among others, highlight the following:

  1. New creations
  2. Distinctive Signs
  3. Copyrights
  4. Plant Breeders' Rights and Plant Varieties.

Finding that the jurisprudences issued were solid, the Court worked on the compilation of relevant matters, so that the judges have within their scope a list of interpretations where it is not necessary to request their interpretation again. This will be reflected in the reduction of time in taking decisions.

New Regulations for the cannabis sector

By means of Resolution 224 of 2024, the government modified Resolution 227 of 2022, extending the term to deliver the cannabis to its final recipient to 48 months counted from the obtention of the harvest. Likewise, the term for licensees to manufacture cannabis derivatives to take their products to their final destination was extended, now they will have up to 48 months from the use of their quota.

The extension of this period demonstrates the Colombian government's interest in promoting research, exportations and development in the cannabis industry.

Attention medical device manufacturers: Resolution 1405 now in effect

From 8 February 2024, the resolution implementing the coding of medical devices and diagnostic reagents in Colombia came into force.

The products that have a current sanitary registration on the date of implementation, enter into a transition period for the registration of UDI DI codes in the Invima web platform. For new products, it is necessary to codes must be registered before they are marketed.
