Philippines: Changes in the trademark renewal requirements issued by IPOPHL

Beginning 25 July 2024, the issuance and publication fees for the renewal of a trademark registration must be paid with the renewal fee upon filing a request for renewal, in accordance with Intellectual Property Office of the Philippines Memorandum Circular No. 2024-023.

In brief

The Intellectual Property Office of the Philippines (IPOPHL) recently issued Memorandum Circular No. 2024-023 ("Circular"), which amends Rules 1200 and 1206 of the Rules and Rules and Regulations on Trademarks, Service Marks, Trade Names and Marked or Stamped Containers of 2023.

Under the Circular, the registration of a trademark may only be renewed upon the timely filing of a request for renewal, the payment of the prescribed renewal fee, and the payment of the issuance and publication fees for the renewal of registration. Both the filing of the request for renewal and the payment of such fees must be made during the applicable reglementary period for the renewal of a trademark registration.

Under the old rules, the fees for the issuance of the certificate of renewal of registration were to be paid only after the filing of the renewal request and the examination of the renewal application, and prior to the issuance of the renewal certificate.

These changes are expected to further streamline the procedure for renewal of registration of trademarks.

The Circular will take effect on 25 July 2024.
