UK: Retained EU Plant Variety Rights - deadline for the appointment of a UK agent approaches

From 1 January 2024, all holders of Retained EU PVRs are required to have a UK address for service or, if the holder is not based in the UK, to appoint a UK agent. In advance of the 1 January 2024 deadline, the UK PVR authority, the Animal and Plant Health Agency (“APHA”), has written to relevant stakeholders to request certain information to expedite the process.

What are “Retained EU Plant Variety Rights (PVRs)”?

From 1 January 2021, Community Plant Variety Rights (“CPVRs”) which were granted before Brexit (i.e. on or before 31 December 2020) were automatically brought over onto the UK PVR register and “cloned” into UK PVRs. Such automatically cloned UK PVRs are known as "Retained EU Plant Variety Rights" in the UK.

In summary:

  • From 1 January 2024, all holders of Retained EU PVRs are required to have a UK address for service or, if the holder is not based in the UK, to appoint a UK agent. To appoint a UK agent, the prescribed authorisation of agent form on the government website must be used (available here: National List and plant breeders' rights: authorisation of agent).
  • In anticipation of the requirement coming into force from next year, APHA has written to stakeholders to recommend that holders of Retained EU PVRs provide certain information to it as soon as possible in advance of 1 January 2024 to expedite the process. The requested information includes confirmation of whether a holder intends to surrender or continue holding the Retained EU PVRs, information about the holder’s UK address for service or details of a UK agent, and details of any change of ownership that has taken place since the rights were cloned into Retained EU PVRs.
  • Once the relevant information is submitted to APHA, the Retained EU PVRs will be issued with a UK grant number and the information will be published in the UK Plant Varieties and Seeds Gazette and Special Edition.
  • If a holder of Retained EU PVRs fails to provide the relevant information by 1 January 2024, APHA may issue a formal request to such holder requesting information about their UK address for service or the name and address of a UK agent. If a holder fails to provide the requested information, APHA is entitled to terminate the relevant Retained EU PVRs, which means the rights will no longer be protected in the UK.

In light of the above, all holders of Retained EU PVRs that wish to maintain their UK rights should take steps to provide the required information to APHA in advance of the 1 January 2024 deadline. We would recommend doing so in good time before the deadline to avoid any delays caused by the inevitable capacity crunch at APHA as the deadline approaches.
