The obligation to provide information about these products is already established in Law 1480 of 2011, which requires suppliers and producers to provide clear, truthful, sufficient, timely, verifiable, understandable, accurate and appropriate information about the products. Through the Resolution, the SIC established and specified the following obligations:
For disposable equipment or devices, suppliers and producers must provide the following information:
- Instructions for use.
- The product's useful life.
- Safety warnings and storage and preservation.
For rechargeable and tobacco-heating devices, suppliers and producers must provide the following:
- Instructions for use.
- Clear and precise assembly instructions.
- A list of accessories.
- Battery type, power, recommendations, and safety warnings.
- Maintenance instructions.
- Warranty period.
- Storage warnings, preservation and proper use instructions.
For oral nicotine products, tobacco substitutes or imitators, suppliers and producers must include the following:
- Instructions for use.
- Safety warnings.
Additionally, the SIC stated that all information must be clear, legible, written in Spanish, and included on labels, packaging and associated components.
Furthermore, in cases where e-commerce is used to sell electronic nicotine delivery systems, similar systems without nicotine, and devices for their operation, suppliers and producers must ensure that consumers have access to clear, legible and written information before purchasing the products.
