Vietnam: Early warning - Potential anti-dumping investigation against office desks, chairs and their parts originating from China and Malaysia

In brief

On 3 June 2021, the Trade Remedy Authority (TRA) of the Ministry of Industry and Trade (MOIT) – the investigator – received a petition for an anti-dumping investigation (AD) with regard to office desks, chairs and their parts originating from the People's Republic of China (China) and Malaysia.

On 18 June 2021, the TRA confirmed that the submitted petition dossier is complete and legal.

Within 45 days from 18 June 2021, the TRA will conduct the documentation appraisal and submit it to the Minister of MOIT, which will decide whether to conduct an AD case or not.


Scope of products

  • Product name (tentative): office desks and their parts, chairs and their parts
  • Origins: China and Malaysia
  • Proposed AD duty rates:
    • Tables and parts: 33.7% to 36.6%
    • Chairs and parts: 21.9% to 26.3%

Documentation appraisal

The TRA will conduct the documentation appraisal to review the petition for an AD investigation and submit the result to the Minister of MOIT, which will decide whether to conduct an AD investigation. The scope of the documentation appraisal is as follows:

  • Appraised target: Vietnamese companies that manufacture/trade in office desks and their parts, chairs and their parts
  • Requested documents:
    • Company's information
    • Design capacity and production capacity for office desks and their parts, chairs and their parts in 2018, 2019 and 2020
    • The company's opinion (i.e., agree, disagree or no comment)
    • Any other documents relating to the appraisal
  • Deadline for submission: 16 July 2021

Announcement

No later than 2 August 2021 (i.e., 45 days after 18 June 2021), after the TRA submits the results of the documentation appraisal, the Minister of the MOIT will decide whether to conduct an AD investigation or not. In some cases, the decision date could be extended once but no more than 30 days.
