What are the objectives and scope of the impact assessment?
Pursuant to the project, the TDRI is tasked with providing recommendations on the legislative direction that Thailand should adopt with respect to platform services. In formulating the recommendations, the TDRI is to consider objectives such as enhancing credibility and transparency, promoting fair competition, and safeguarding consumer rights.
In particular, the TDRI is tasked to do two things:
- Assess:
- The impact of enforcing the Electronic Transactions Development Agency Act B.E. 2562 (2019) and the Royal Decree on digital platforms requiring notification B.E. 2565 (2022) and its subordinated legislation.
- The potential impact if the Platform Economy Act – a draft legislation that draws from the European Union's Digital Services Act, Digital Markets Act, and the Platform-to-Business Regulation – were to be enforced.
- Identify and compare the risks, problems, and legal landscape regarding platform services adopted in the ASEAN and other countries (e.g., the EU and the US).
How long is the project?
The TDRI has 270 days to complete the project. There will be three rounds of public hearings, during which the TDRI will present its findings and gather feedback. Businesses and consumers can participate in these hearings, using them as a platform to voice their concerns and provide comments.
