Peru: Update to list of non-cooperative countries or territories with low or no taxation

In brief

The Peruvian tax authority ("Superintendencia Nacional de Aduanas y de Administración Tributaria" (SUNAT)) has published an updated list of non-cooperative countries with low or zero taxation ("Low Tax Countries") and has distinguished those Low Tax Countries with which Peru has an Information Exchange Agreement ("Low Tax Countries with an Agreement").

As a result of this update and the amendments to means of payment effective as of 2023, it has been established that payments channeled through Low Tax Countries will not qualify as an authorized means of payment and they will not be entitled to be deducted as an expense or cost to taxpayers.

On the contrary, the channeling of payments through the financial systems of Low Tax Countries with an Agreement will qualify as an authorized means of payment for tax purposes in Peru.
